By using ClownVPN, you agree: don't use it for illegal stuff, we owe you no service-level guarantees because it's free, ads are how we keep the lights on. The rest is legal precision.
1. The Agreement
These Terms of Service ("Terms") are a contract between you and ClownVPN, Inc. ("ClownVPN", "we", "us") governing your use of the ClownVPN app and clownvpn.com.
By downloading or using the app, you accept these Terms and our Privacy Policy. If you don't accept, don't use the service.
2. What ClownVPN Is
ClownVPN is a free, ad-supported Virtual Private Network. We route your device's internet traffic through an encrypted tunnel to one of our servers, then out to the public internet. This is intended to add a layer of encryption to your traffic and to protect against local-network surveillance (e.g. on public WiFi).
ClownVPN is not:
- An anonymity system (use Tor for that).
- A guarantee against deanonymization by your applications, browser fingerprints, or logged-in accounts.
- A tool to circumvent laws, contracts, or legal restrictions applicable to you.
3. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use ClownVPN. If you're below the age of majority in your jurisdiction, a parent or guardian must agree to these Terms on your behalf.
You must comply with all laws applicable to you, including export-control and sanctions laws. We don't operate in jurisdictions where providing VPN services is prohibited.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the ClownVPN app on devices you own or control, solely for your personal, non-commercial use.
You may not:
- Reverse engineer, decompile, or disassemble the app, except as allowed by applicable law.
- Resell, sublicense, or commercially redistribute the service.
- Use the app to operate any service that competes with ours.
- Circumvent the ad display.
5. Acceptable Use
You agree not to use ClownVPN to:
- Commit fraud, distribute malware, or attack others' systems.
- Send spam or run unsolicited bulk communications.
- Distribute or access content that exploits or endangers children.
- Violate intellectual property rights of others.
- Violate any law applicable to you or your conduct.
We reserve the right to terminate access for any user we reasonably believe is violating this section. Because we don't log VPN traffic, enforcement is generally complaint-based and confined to obvious abuse signals at the network edge.
6. Ads
ClownVPN is funded by ads displayed in the app. By using the free tier, you agree to the display of these ads. Ad networks may collect their own data subject to their own privacy policies — see our Privacy Policy, section 7.
7. No Warranty
The service is provided "as is" and "as available", without warranty of any kind. We don't guarantee uptime, speed, freedom from interruptions, or fitness for any particular purpose.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, ClownVPN's total aggregate liability to you for any claim arising out of or in connection with these Terms or the service shall not exceed US $50.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, even if advised of the possibility of such damages.
Some jurisdictions don't allow these limitations. In those jurisdictions, our liability is limited to the smallest amount permitted by law.
9. Termination
You can stop using ClownVPN at any time by uninstalling the app. We can suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms.
Sections that by their nature survive termination — including Disclaimers, Limitation of Liability, and Governing Law — will remain in effect after termination.
10. Changes To These Terms
We may update these Terms when we add features or laws change. Material changes will be announced at least 30 days before they take effect, in-app and on this page. Continued use of the service after the effective date constitutes acceptance.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles.
Any dispute arising under or in connection with these Terms shall be resolved by binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, conducted in English in Wilmington, Delaware. You waive any right to participate in a class action.
If arbitration is unenforceable in your jurisdiction, disputes shall be brought in the state or federal courts of Delaware.
